Terms of Service

Challengeez is operated by Qweek LLC("Challengeez," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Challengeez mobile app, website, and related services (the "Service").

You must be at least 13 years old (or the minimum age required in your country) to use Challengeez. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

• You are responsible for keeping your account credentials secure. Do not share your password.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at security@challengeez.com if you suspect unauthorized access.
• You may not create accounts using false information, impersonate others, or operate multiple accounts to evade enforcement actions.

You retain ownership of the content you create on Challengeez (posts, challenges, broadcasts, podcasts, vlogs, comments, messages, Boutique listings — collectively, "Your Content").

By posting Your Content, you grant Challengeez a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes like resizing), distribute, and display Your Content as necessary to operate, improve, and promote the Service. This license ends when you delete Your Content or your account, except as needed for backups, legal compliance, or where others have already shared Your Content.

You represent that you own or have all necessary rights to Your Content and that it does not violate any law or these Terms.

You agree NOT to:

• Post content that is illegal, harassing, threatening, hateful, defamatory, sexually explicit involving minors, or that incites violence.
• Impersonate any person or misrepresent your affiliation with anyone.
• Spam, phish, scam, or distribute malware.
• Infringe anyone's intellectual property, privacy, or other rights.
• Scrape, harvest, or extract data from the Service except through approved APIs.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to compete with Challengeez or to build a competing product.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related infrastructure.
• Use bots, automated scripts, or fake engagement to manipulate features (followers, likes, views, payments).
• Sell or facilitate the sale of illegal goods, weapons, drugs, counterfeit items, or anything restricted by Apple's App Store Review Guidelines.

We may remove content, suspend, or terminate accounts that violate these rules, with or without notice.

The Boutique lets eligible creators sell goods, services, and digital products to other users. Boutique transactions are processed by Stripe. By using the Boutique, you also agree to Stripe's Connected Account Agreement and Services Agreement.

• Sellers are responsible for accurate listings, delivering what they sell, complying with tax obligations, handling customer service for their sales, and following all applicable laws.
• Buyers are responsible for reviewing listings before purchase. Refunds and disputes are primarily between buyer and seller; Challengeez may step in for clear policy violations.
• Challengeez may charge service fees on Boutique transactions. Current fee rates are shown in the app.
• We may withhold payouts or freeze accounts in cases of suspected fraud, chargebacks, or violations of these Terms.

Some features may require in-app purchases or subscriptions processed through Apple's App Store. Apple's terms govern those transactions. Subscription auto-renewal, billing, and cancellation are managed in your Apple ID settings.

The Challengeez name, logo, app design, software, and all related materials are owned by Qweek LLC and protected by intellectual property laws. Except for Your Content, you may not copy, modify, distribute, or create derivative works from the Service without our written permission.

You may delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, create risk to other users or the Service, or for any other reason at our discretion.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (e.g., ownership, indemnity, limitations of liability, dispute resolution) will continue to apply.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Qweek LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100.

You agree to indemnify and hold Qweek LLC harmless from any claims, damages, losses, or expenses (including attorneys' fees) arising from (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any rights of another party.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we make material changes, we will notify you in the app or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
